Hello, my youtube channel has been terminated recently. Anyway, I will go straight to my point: I was trying to upload back some of my video that are clean (no copyright notices) but unfortunately, I couldn't find my video in my computer. So I am here suggesting that instead of terminating/suspending accounts, why not just disable the upload feature for us? In that case, our clean video are still available to everyone else. I mean it's just unfair to us that we got our accounts terminated forever without a good reason and our clean video are also deleted just because of the infringed video. I mean everyone should at least have one chance. I'm sure many other will be delighted to have our accounts back. Please, agree to my suggestion this time round.

Once you are suspended you are not permitted TO have/access/create another YouTube channel.  You are not permitted to use YouTube with a channel at all.

Breaking the rules/law after you agreed to them is also "unfair".  Simply put:  you agreed to the terms, you broke them, you got caught.  Seems pretty fair all around. 
 
I mean everyone should at least have one chance. I'm sure many other will be delighted to have our accounts back.
 
In most cases a channel is only terminated and the user suspended from YouTube once they have been given three chances and still kept breaking the rules/law.
 
Please, agree to my suggestion this time round.

You agreed to the terms (more than suggestions) so there is no point asking them to change the rules/law to suit you now.

I've been flagged twice and YouTube has upheld two strikes on me, without providing ANY reason for it. They won't tell me what I did "wrong" so I can refrain from doing whatever I did in the future...and that's a problem, b/c I have over 650,000 video views currently and over 6000 subscribers who look to me for my wisdom, knowledge, and experience. YouTube is just a big, shadowy bully that likes to throw its weight around, and it is apparently not concerned with who it hurts in the process.

You will have been told something, like that the videos are removed for copyright infringement or community guidelines violations.  So- could it be for the links in the video descriptions?
 
They won't tell me what I did "wrong" so I can refrain from doing whatever I did in the future...

The problem is that you agreed to the terms when you signed up and, as a broadcaster, are expected to know when you are breaking those terms without someone having to tell you that you are.  Meaning that if you do not you need to read the terms again.  :(

No, YouTube is the company who asked you to agree to terms in order to use their facility.  And who make it clear that if videos are flagged by members of the community they will be reviewed by Google staff who determine if a violation of their terms has occurred.  It is not something which YouTube is doing to you (ie bullying you)- it is other users and, at the end of the day, you when applying (or not) your knowledge of the rules/law.

To your question. After reviewing your channel and a couple of videos, I am surprised your channel has not already been shut down for, "Spam, scams, and deceptive content."

You have an Amazon Store affiliate link and a Clickbank affiliate link in your descriptions. Usually, this results in instant termination. Also, you are keyword stuffing, meaning adding extra tags at the end of your description and this violates the TOS.

I mean- am I being too subtle and expecting people to do a bit of thinking for themselves (ie take responsibility)?

When a person knows what they did wrong but decides to feign the victim instead (YT is being a "bully") there's no sense in subtlety.

Living show all i can tell you and lowcarbcory is and what the lady from uncle said, you agreed when you made you accounts to the terms and everything else and that you are liable to anything you do, so it's only your fault if you broke the rules not youtube's.

Copyright infringement is breaking a law, namely international copyright law.

With "rules" the terms of service are being referred to.  (and check out the second word in 1.2 as a matter of interest)

The OP (original post) refers to "copyright notices".

"Copyright notices" implies that they were for videos which were found to be uploaded against the rules (the terms of service) and most probably against the law (as copyright infringement is theft of IP).

As for your "petty" and exceedingly ridiculous threats-  are you serious?

Let go straight to the point:

1. Firstly, why are you assuming that I am accessing/creating a new channel? This could be the channel of someone related to me and I asking them to help me out. Also, are you trying to tell me that those suspended are not allow to create new account? What you are saying is "prisoners that are release are not allow to communicate with the world". Well, since it is part of the Youtube terms and condition, I have nothing against it.

2. I may want to counter-notification of the copyright infringement notice. However, to do this, I am required to log in to my account.

3. I don't even have three chances. The 2nd and 3rd copyright infringement directed at me was within a few days. The moment I logged in back, my account was terminated. How can you explain this. Before my account was terminated, I was planning to remove away those video that might be copyright infringed. However, everything happened so fast that I did not even have the time to do anything. Furthermore, if I were to receive a second copyright infringement, I would definitely not risk my channel any further and would remove any video that may contain copyrighted materials.

4. What about our clean video? Since they are clean, why removed them?

5. I did agree to the terms and I did respect the Youtube Community. Even today, I did not and never will abuse the site.

All I am asking is to return my account. I know it may be a tough decision but to me, it's very important. I apologised if I sounds threatening. My only intention is I need my account back. Thanks you in advance if you would kindly return my account.

It doesn't matter if it is a new one.  You (meaning you personally) are not permitted to access/have/create any YouTube channel any longer.  If someone else is willing to risk also being suspended by letting you use their channel, so be it.  Their responsibility.

Yes.

No, I am saying that you are suspended from YouTube and YouTube do not permit you to use YouTube any longer.

Yes, it is hard to counter-notify when you are already suspended.  You would now need to get the claimants to withdraw their claims altogether, I should think.

You had however many chances as you uploaded copyright infringing videos while ignoring the warnings not to.  So if you uploaded a hundred copyright infringing videos then you had a hundred chances to heed the instructions not to.  Well- a hundred and one because you ALSO agreed not to infringe copyright or otherwise break the law when you signed up for your channel.

Ah.  Too late.  You were caught before you removed the videos which you ought not have uploaded in the first place.  :(

You will have had more than two copyright infringements or community guideline violation strikes.  It takes more than two to terminate a channel.

I hope you didn't include me in that count.  We are not suppose to break rules even when we have been unfairly treated.  My former other channels are now in the possession of my friend until my ytBG channel problem with YouTube gets cleared up or reaches a point where I give up trying to get it back.  And my friend is not even logging into those accounts to avoid the appearance of evil on our parts as well.

One final question:

The youtube appeal team never actually read what we wrote. I sent in 3 appeals and the message I receive back is all the same (and they are not answering my appeals). Hence, is there a better way of directly contacting to the appeal team?

Yes, they did read it as the review process isn't automated.  Someone has to review your case and decide to either uphold the original decision or not.

If you were told already that the decision is to uphold the original decision then it wont matter how many times you send it in.  You have done what you can and YouTube are not going to change their decision.

You are not allowed to have any accounts on YouTube as you were banned for repeated copyright infringement.  As soon as YouTube connects the dots your new account will be terminated.

It is a very, very steep learning curve and I am still learning about it all the while.  One day it may be a thing of the past, that we must get clearance to "share" online, but until then we are stuck with how things are.

Hi, sorry to hijack this thread a little, but while reading the comments, something worried me about one of the answers above and I just had to get a better explanation:

This is the statement that got me worried! I have AdSense and am in the affiliate network, however I have no other website other than my YouTube channel. I have received emails from AdSense encouraging me to post links on 'my websites' promoting certain businesses that accepted me. I had always assumed this was nearly the same as posting ads on 'my websites' (YouTube) which obviously, is AdSense's main purpose.
 Since my YouTube channel is mainly about trains, and one of the links AdSense sent me was about model train collecting, I have put that link in the description of several of my train videos.
 Is this wrong? I surely don't want to jeopardize my YouTube or AdSense accounts. I had just assumed this is what I was supposed to do, since AdSense seemed to encourage it. I have not had any negative responses from YouTube about doing anything wrong, so I'm really not sure now. 
 Is this a gray area? Something that is regulated on a case-by-case basis? Reading the quoted sentence above makes it sound like I could be instantly terminated! I just though I was doing what Google encouraged, and I haven't had any problems yet.... could anyone let me know??? Thx!

Looks like they have changed their mind and actually require you to have all three strikes expunged.  This can happen.
