I have a blog attached to my website - www.swssociety.com - the blog is called Surviving Jennifer and is about my ex and his affair with his secretary. I try and make if funny and have had a huge response - 3000 hits in a few weeks. But I wanted to know if I can use a family photo with him in it - if it has been published on the internet by someone other than me....like a Facebook photo? Does anyone know the rules to that.
He keeps trying to close my site down - has been successful twice. Even though I do not mention his last name and there is no identifying information on there for either he nor Jennifer.....
any advice from long term experienced bloggers sure would be appreciated!!

I don't think you can put it up without permission from him.

Unless he gives you explicit permission, I think he might have the right to request the picture be taken down under claims that you're posting it for vindictive and vengeful reasons. Unless you somehow show that the picture is meant to show how good-looking he is (something along those lines), he'd probably win every time. After all, what good (positive) reason would you have to show pictures of your ex who cheated?
