Firstly if you are being click bombed (which I would assume your are) I would ensure you are using the "Allowed SItes" list and NOT put your URL in it. This means you wont get paid for any clicks.

Next you should install something like Stat Counter so you can start investigating where the clicks are coming from.

I would recommend removing the code for some time if you fear that you are going to lose your account due to this.

If they're using the Allowed Sites function & not have that site in the list there is no need to remove the code. If they remove the code they will have no idea when it's safe to place the code back on the site. As long as the code is there but protecting the advertisers they'll be able to know if that activity has ceased.

Unfortunately in this case statcounter may not be able to help you much in finding where the issue is coming from but they came from the same source as at least one of those 40 clicks you do see. Do you also have Analytics on the site & connected to Adsense? If so Analytics should have recorded them even though statcounter didn't. 

You should definitely report that activity even if the earnings were already deducted if you haven't already done so.
