AN UNAUTHORISED PAYMENT OF £46.95 HAS BEEN TAKEN FROM MY ACCOUNT BY GOOLE PROFIT CLUB slsmith74 8/1/09 7:46 AM
I SAW AN AVERT WHILST ON ANOTHER WEBSITE FOR MYSTERY SHOPPING AT GOOGLE PROFIT CLUB STATING THAT I COULD JOIN FOR £2.49. AS THIS WAS SUCH A LOW PRICE TO PAY I DECIDED TO  GO AHEAD AND GIVE IT A GO.MONEY IS TIGHT OVER THE 6 WEEKS SHOOL HOLIDAY SO THE EXTRA INCOME WOULD COME IN USEFUL. I HAVE JUST BEEN IN TO MY ONLINE BANK ACCOUNT AND SEEN ANOTHER AMOUNT OF £46.95 PLUS £1.50 TAKEN OUT FROM GOOGLE PROFIT CLUB. I HAVE NO IDEA WHY THIS MONEY HAS BEEN TAKEN AS I CERTAINLY DID NOT READ ANYTHING ABOUT ANYMORE PAYMENTS.  I CANNOT FIND A NUMBER TO RING GOOGLE SO AM HAVING TO CONTACT VIA THIS MESSAGE.  I NOW FEEL THAT I HAVETO CANCEL MY BANK CARD AS I CANNOT TRUST THAT ANY MORE MONEY WON'T BE TAKEN OUT WITHOUT MY CONSENT. THIS IS A TOTAL INCONVENIENCE FOR ME TO HAVETO DO THIS AND I FEEL SO UPSET THAT I WAS TEMPTED BY THIS AS IT CLEARLY ISN'T WHAT I SIGNED UP FOR.  I HAVE A LITTLE BOY WHO I NEED TO SUPPORT ON MY OWN AND THAT £50 IS NEEDED FOR THAT.  I WOULD LIKE THIS MONEY REIMBURSED TO MY ACCOUNT AS I HAVE BEEN TOTALLY MISLEAD. PLEASE EMAIL BACK AT slsm...@tiscali.co.uk   SARAH SMITH

Hi Sarah

There is unfortunately an ever increasing number of companies/individuals/scams around trying to pass themselves off as Google. It would appear that Google Profit Club is another one of these.

Take a look at the following on RipOffReport...
Re: AN UNAUTHORISED PAYMENT OF £46.95 HAS BEEN TAKEN FROM MY ACCOUNT BY GOOLE PROFIT CLUB Sasch 8/1/09 7:56 AM
P.S. And yes... The best course forward from here would certainly be to cancel your bank card and ensure that these scamsters are no longer able to use any of the details you gave them...

Yup -Google is not involved in these scams in any way:

How have they drawn the money, via a credit card, either way contact your bank and report it ?

The money must be returned if a DD has been setup and you did not agree to it.  Your Credit card also has protection.
Re: AN UNAUTHORISED PAYMENT OF £46.95 HAS BEEN TAKEN FROM MY ACCOUNT BY GOOLE PROFIT CLUB Phil Payne 8/1/09 9:11 AM
The problem being that there's nothing wrong with the charges - they have been agreed to.  True, it's very well buried in the small print - but caveat emptor Even cancelling the card may not help, because some card companies accept charges after the cancellation.  If you completely and effectively block payment, you may even find they'll set the debt collectors on you.

It's a scam, it's underhand and it's immoral.  But it's probably not illegal.
Re: AN UNAUTHORISED PAYMENT OF £46.95 HAS BEEN TAKEN FROM MY ACCOUNT BY GOOLE PROFIT CLUB MissHepburn 8/1/09 9:53 AM
If it’s a scam, as being said here, how on earth can they enforce the collection of money or send in debt collectors.  If they have taken money by credit card, then they have signed up to the T&Cs of the bank involved.
Utterly ridiculous, if this is a scam please go and inform your bank ASAP, tell them what has happended.  They may refer you to their Fraud/Internet Security department as well.  Also contact the citizens advice first thing Monday for free advice, take them as much information as you can, the website, the contract, if you have signed up to one and the payments you authorised and the payments you did not, how you found the website and why you believed it was a Google product, that gace weight to your purchase.

Also, contact the consumer program watchdog at the BBC with your story, the newspapers and your local BBC and ITV new stations.  STOP others in your situation from making this mistake please.
Best Wishes
MH

Please see this report, as you may be expected you to pay more money, and every month.

I have just been onto a website offering a similar product, but am not sure if this is the website you are talking about.

I am certainly confused, we had an incident here a while back where John MU, a Google employee told a webmaster of a Games site that he had to contact GOOGLE legal by email as there was an issue flagging on his listing in the search results.

Others questioned his ownership to the brand name displayed on his website, the information he was requesting etc.  This website was marked with a warning by Google search listings, so visitors understood a potential issue right away.

My question is, how can a company unrelated to Google, be allowed to use the Google TM ??? and not have their search results devalued, banned or have a warning issued against its listing.

Anyone ?

God I hate these people.  They contacted my dad and thank god he asked me first.

You see a lot of people rant and rave, but I never see any response whether they get their money back. Anyone know if it's typical for the charge cards and bank to give back the money? Or do most people have to eat the charge?

You have to contact your bank first, they will investigate.

In the UK, there is a law about purchasing on the web a cool off, 7 days,

Ive seen some of these around and joined... Heres what I experienced.

I signed up for the Google Profit Club a week or two agao for the 5 day trial. I saw the $74.93 in the terms and in the footer of the site. I figured why not I have 5 days...

Well the system is pretty neat. It teaches you all about affiliate marketing and how to use Google Adwords to make money. I used some off the Clickbank products on the site and promoted them on google and made $40 my first day and its growing every day. To make the $600 a day they state I need to put in more effort but these things are definitely NOT a scam. The $74 charge is of course overwhelming to most people. I think its worth it as Im using adwords daily and so far this has been working for me :)

The problem with sites like http://secure.securewebordering.com/offer/go3/ (don't go there - it messes with the back key) is that they're disposable - they don't need to be in the search engines because they're accessed via affiliates - even if one gets taken down, the affiliates just need to be switched.
Re: AN UNAUTHORISED PAYMENT OF £46.95 HAS BEEN TAKEN FROM MY ACCOUNT BY GOOLE PROFIT CLUB MissHepburn 8/1/09 10:57 PM
>> they don't need to be in the search engines because they're accessed via affiliates

Maybe they don't need to be in Googles own search engine listing, but they are and using the Google TM, at number 3 in the charts.

I see hundreds of people losing ranking because of minor issues with JS, canonical issues and some major issues such as malware etc, but it appears that the Google Algo cares little about its own name and TM.

>> Google is all about protecting the visitor ??

The United States currently has a population of 304,000,000 (approx.)
Google's US users currently number 130,000,000 (approx.)
That's 42.8% of the country's population (approx.)

Throw in the European Union, and you have yourself another 491,000,000 residents (approx.) with very similar web habits as the Americans.

Dump on the Canadians, Australians, Kiwis, Arabs and everyone else in the so-called civilised world and you have a load more people (approx.) to boot .

I could go on, but there'd be little point as the statistics are truly meaningless beyond the simple twofold fact that Google has a vast number of global users (approx.), and is not in fact the Internet police.

Nor can they be held responsible for people pretending to be them, beyond suing the proverbial arse off them if/when they are caught, of course. But even that is shaky territory, since most of the Pretend-Google outfits in question operate from shady, corrupt countries without much legal recourse, thus making it hard to pursue them.

Anyways... Given the terms and conditions quoted above, there is not actually anything illegitimate about the charge in question, since it is clearly laid out in black and white. Over the years, I've written reams about the average user's failure to take software/Internet terms & conditions seriously, and I'm not the only one. And yet the overall user attitude has changed little during the last decade... It's easier just to click I Agree, than to actually read through things, isn't it?

So while the Google Profit Club is without question a vile and despicable scam, it is not in fact dishonest from a purely legal standpoint.

It's what you might call The Letter of the Law vs The Spirit of the Law.

I my experience, the Spirit usually takes a beating when the law is applied to the letter...

The Onus, therefore, is on users to protect themselves by reading the relevant terms and conditions very carefully, because there's nobody around to save them if they get it wrong.

After all, when the fake fireman knocks on your door to sell you the overpriced, made-in-China smoke alarm, you don't see the real fire brigade pulling up and beating the snot out of him, do you? Nope, you have to make the decision whether to fork over steep price for the piece of crap, or kick the little bastard in the shin and tell him to p*ss off.

Sorry Sarah, but there it is... Make sure you cancel that card and cancel your subscription...

>> You only have yourself to blame. As other have pointed out, its clearly in the terms and conditions you agreed to.

I'm not sure, I went through part of the transaction I got to the debit/credit card bit, but no "I AGREE" up till then.

Either way this type of thing has to stop.  If we want a global shopping mall, then we need global cosumer laws to protect the consumer.  For every one person who buys on the web, I'm sure that there are 1000's that don't, and this is exactly the reason why.

The european union should safeguard its population from any potential rip offs, by licensing e-commerse sites who trade within their borders.  Also this license, would require EU citizens personal and sensitive data be treated according to european laws.

Obviously other countries should adopt the same license and register to trade on the internet.  Like a WC3 validation logo, you could click the logo to view the license to trade via a .gov website.

Over to You ?

>> I'm not sure, I went through part of the transaction I got to the debit/credit card bit, but no "I AGREE" up till then.

Not strictly speaking necessary... All you'd need would be a small-print statement hidden on the page somewhere to the effect that by completing the transaction you're agreeing to the Terms & Conditions...

It's somewhat akin to the way Murcoshoft used to put the licence agreement in an envelope, and the first thing the agreement said was that by opening the envelope you agreed to be bound by the Terms & Conditions...

Ah, the nostalgia... brings a tear to me eye... :-Þ
Re: AN UNAUTHORISED PAYMENT OF £46.95 HAS BEEN TAKEN FROM MY ACCOUNT BY GOOLE PROFIT CLUB Becky Sharpe 8/2/09 1:41 AM
The UK, at least, has protection for the shopper in the shape of the Distance Selling Regulations http://www.opsi.gov.uk/si/si2000/20002334.htm which offer protection far greater than that which is given in a High Street transaction. PayPal offers a good deal of protection to the buyer, in that the buyer is, by default, in the right unless the seller can prove otherwise. A complaint to Trading Standards may bring a response where the website is at fault, though that does not apply in this case.

However, as Sasch says, it really is a case of caveat emptor. If people don't take the time to read the T&C and agree to an unread document then they only have themselves to blame. There will always be companies who exploit the vulnerable, both online and off.

Sorry but this is for Member EU States only... did you not read the small print ;-)

>> If people don't take the time to read the T&C and agree to an unread document then they only have themselves to blame.

I must disagree, when was the last time you spent 15 minutes reading the T&C's before buying anything on the internet.  Come on, we are all guilty of this from one time or another.  Its the reason why we are shopiing online in the first place, because we haven't time to spare to go down the shops ?

My question is therefore still open.

Hi,
If this information is correct, then it appears that the ecommerce site selling in the UK, may have to abide to EU and UK laws.  Please read this as it requires verification from someone in the KNOW from the USa ?

>> I must disagree, when was the last time you spent 15 minutes reading the T&C's before buying anything on the internet.

Every single first time with any site...

Back in 1999 I was distributing a free security CD with the stuff I was shipping. Clients had to agree to the terms & conditions before being able to get at its contents.

As an experiment, Clause 27 of my terms quite clearly specified that by agreeing, the client consented to wear his or her underwear outside their regular clothing for a period of six months. I had a load of feedback from that CD, but not one client pulled me up on the rogue clause...

And that is precisely the problem... Agreeing to on-screen terms & conditions can nail you to the wall just as surely as putting a signature on a contract; and that's what people will need to realise, because global consumer protection is still a ways off and scams like these will remain a fact of life for some time to come...
Re: AN UNAUTHORISED PAYMENT OF £46.95 HAS BEEN TAKEN FROM MY ACCOUNT BY GOOLE PROFIT CLUB MissHepburn 8/2/09 2:17 AM
Just to repeat, it looks as though UK law applies, so there should be a 7 day cooling off period.  This will require the OP to contact a solicitor for advice or the CAB.

I am also interest to know what taxes we paid, as these should be indicated to the consumer even in the US shouldn't they??

How can British, or indeed European, legislation apply to Non-EU member states? See? The thing about EU laws is that they apply only within the EU. That's how that works...**

Becky never actually said "In Britain, our consumer laws protect us from the rest of the world." what she did in fact say is that "The UK, at least..."

I suppose we could always petition for an legislative amendment which allows Gordon Brown to send the boys round to any Non-EU retailer who doesn't comply with local laws and scams the UK's citizenry... :-Þ

Until such time as that comes into force, however, I think it'd still be best for everyone to read the fine-print...

**China, of course have long since realised this, which is why they've had two fingers stuck up to copyright laws for quite a while now...

Just cancel the card and dont get involved with crud like this again.
I wouldnt trust a website that has many duplicates banned from Google and uses nasty pop ups and screws with my back button.

Cancel card - hassle yes but = peace of mind.(especially if its a bank card which offers less protection than a credit card)
send email to Google profit club to inform them you no longer want to be part of their deceptive scheme.

In future check with google help forums BEFORE signing up to something you feel is related to google.

That is the very reason why Google set up these forums - to offer help and advice.

Strange, this is against their T&C of cancellation, you may wish not to follow this advice and ring them as the T&Cs dictate.

This post is about a service/product that was purchase from a USA based website,

>> BECKY:  The UK, at least, has protection for the shopper in the shape of the Distance Selling Regulations http://www.opsi.gov.uk/si/si2000/20002334.htm which offer protection far greater than that which is given in a High Street transaction.

>> Sasch: Becky never actually said "In Britain, our consumer laws protect us from the rest of the world." what she did in fact say is that "The UK, at least..."

Then what use is her comment to this post, relecance=NIL, importance=NIL, ranking=-30

But you may find that local laws applies when a UK resident buys a product or service from anywhere else in the world, unless they click to "I Agree" to the T&C's

My post is at least relevant to the subject and possibly helpful to the poster.  Better than snearingly saying its your own fault for not reading, what kind of people are you ?

While the OP's issue has been clarified, in that Google is not the responsible party here, the following Help Center Article addresses a number of issues that have been brought up. While it is still not a perfect solution, the more people who use the various reporting mechanisms can at least feel as if they tried to do something.

A site ripped me off
http://www.google.com/support/websearch/bin/answer.py?hl=en&answer=9110

In the US, the FTC is beginning to crack down on these outfits because of their unfair and deceptive practices.  So, even though the information may have been in the "fine print" it is still worthwhile to report to the FTC and other organizations listed in the Help Center Article.

In addition, there is a link in the article to use for reporting Google trademark violations and another link for reporting AdWords violations.  At least some of these sites are beginning to disappear from the index, even though they are still accessible through other means.

Not only does it mention it in the terms and conditions you agreed to, but they took out that line and put it on there page as well. Perhaps so you wouldnt have to search for it. In the footer:

Flyersman, do you represent this website/business.  If so, would you be willing to cancel the OPs subscription and confirm it in here and by email to her account ?

I think it would also be useful to provide an email address cancellation for those outside of the US. How much does it cost to ring this 772-205-3384 number from the UK ?

flyersman - I have fallen for the same trick re GPC. I am unable to make any contact from Australia to the GPC on the phone numbers given. Maybe you could provide a 'real' contact number where I can cancel membership!!!!   8paws

Hi, I was caught out too, I only found out today when my bank statement arrived. I called USA to have it cancelled. Tel: 001 772 205 3384.  The guy I spoke to said I ticked the box to pay monthly for using their site (which I have not been on), I only paid $3.95 to download an article.  This is where we can fight back, the box is already TICKED, we did not tick the box as they are saying. If you go on the link you will see the box has already been ticked!   https://secureweb.secureweboffer.com/offer/go3/step2/?ai_sid=4003&ai_sid_key=nir2rq9ghl&ai_sid=3881&ai_sid_key=x9y
I was told that because I ticked the box they cannot refund me the money so I am going to dispute it by filling in the form that my mastercard company is sending me and I am calling the advice line for Cit Adv Bureau in the UK Tel 0870 770 8175 tomorrow.  Hope this helps.
